"That notwithstanding, they concluded he was lying".
Trump attorney Rudy Giuliani Sunday said the president would be interviewed by special counsel Robert Mueller "over my dead body", dismissing Mueller's team as "a joke" in an interview on "Fox News Sunday." His lawyers said he turned over thousands of documents, and the special counsel's office has said that he has also aided a criminal investigation they haven't yet revealed.
However, many of Flynn's supporters have questioned the legitimacy of the case against him.
Nevertheless, then-Acting Attorney General Sally Yates was reportedly "not happy" about the plan to interview Flynn about the Kislyak discussion, which took place during the presidential transition. One of the documents is a memo authored by former Deputy FBI Director Andrew McCabe summarizing his involvement in Flynn's January 24, 2017, FBI interview.
The meeting with Flynn in the White House was set up by then-FBI Deputy Director Andy McCabe, who served as the agency's acting director after James Comey was sacked by Trump as FBI director in May 2017.
Flynn initially denied but eventually said that they had discussed sanctions and a United Nations resolution during the presidential transition.
Mueller said Flynn, as a "sitting National Security Advisor, former head of an intelligence agency, retired Lieutenant General, and 33-year veteran of the armed forces" knows better than to lie to federal agents and "does not need to be warned it is a crime to lie to federal agents".
Michael Flynn also agreed to meet with the agents without a lawyer.
"When faced with the FBI's questions on January 24, during an interview that was voluntary and cordial, the defendant repeated the same false statements".

But if he had a dual goal to influence the campaign, that could be a real issue. It's multiple witnesses-and the opinion of the court-against Trump on this one.

The Tennessee Republican added: "If he was in front of a jury, he would be convicted in 30 minutes ". Asked by a reporter if it would be a murder conviction, Corker replied "yes".
The FBI memos make clear that top Justice Department and bureau officials knew that Flynn's public story about his calls with Kislyak differed than what he actually said to the ambassador on the phone during the presidential transition - and the agents who spoke with him at the White House about it were prepared to confront him.
During the interview, Flynn denied asking Kislyak that Russian Federation refrain from reacting harshly to sanctions imposed by the Obama administration over Russia's campaign of disruption and said he did not remember Kisklyak saying that Moscow had backed off as a result of Flynn's request. Flynn will next week become the first White House official punished as part of special counsel Robert Mueller's ongoing investigation.
"But the defendant never corrected his false statements", the memo states.
Flynn served as Trump's national security advisor until his February 2017 resignation.
In the memo, Flynn expressed "genuine contrition for the uncharacteristic error in judgment that brought him before this Court".
Yet the documents show that the decision to interview Flynn in early 2017 about contacts with the Russian ambassador was controversial within the Justice Department. But Comey described that description as a "garble" in a private interview with House lawmakers last week.
JOHNSON: The lawyers don't go so far as to mount some kind of entrapment case, but they are offering some suggestions if the judge who's ultimately going to sentence Mike Flynn next week wants to grab at those. He said the president directed him to make hush money payments to women during the 2016 campaign. "Flynn did not introduce them to anyone".
The filing came as lawyers for former Trump campaign chairman Paul Manafort said they were still deciding whether to dispute allegations that he lied to investigators and breached a plea agreement.
